Right of withdrawal

1. Information on the Right to Withdraw from the Contract and the Withdrawal Form Template

1. Consumers have a 14-day right to withdraw from the contract. This right also applies to individuals concluding contracts directly related to their business activities if, from the content of the contract, it is clear that the contract does not have a professional character for these individuals, as defined by Article 556(4) of the Civil Code. Other entrepreneurs are not entitled to the right to withdraw from the contract.

2. Right to Withdraw from the Contract

1. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you acquire physical possession of the goods or a third party other than the carrier and indicated by you acquires physical possession of the goods.
2. To exercise the right of withdrawal, you must inform us (Karol Stawczyk, ul. Godebskiego 27a, 05-090 Raszyn, Poland, sklep@obuwie-taneczne.pl, phone: 786-118-600) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the withdrawal form template sent to you as an attachment in .pdf format after placing the order, but it is not mandatory.
3. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3. Effects of Withdrawal

1. If you withdraw from this contract, we will reimburse you all payments received from you, including the costs of delivery (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
2. Please send back or hand over the goods to us at the following address: Karol Stawczyk, ul. Godebskiego 27a, 05-090 Raszyn, without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
3. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
4. The right to withdraw from a distance contract does not apply to the consumer in respect of contracts:
   • a) for the provision of services, if the entrepreneur has fully performed the service with the consumer's prior express consent, and the consumer was informed before the provision began that they would lose their right to withdraw from the contract once the service had been fully performed;
   • b) where the price or remuneration depends on fluctuations in the financial market that are beyond the entrepreneur's control and that may occur within the withdrawal period;
   • c) where the subject of the performance is a non-prefabricated item, made to the consumer's specifications or clearly personalized;
   • d) where the subject of the performance is an item that is liable to deteriorate or expire rapidly;
   • e) where the subject of the performance is an item delivered in sealed packaging that cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery;
   • f) where the subject of the performance are items that, after delivery, are inseparably mixed with other items due to their nature;
   • g) where the subject of the performance are alcoholic beverages, the price of which was agreed upon at the conclusion of the contract of sale, and their delivery can only take place after 30 days and their value depends on fluctuations in the market beyond the entrepreneur's control;
   • h) where the consumer specifically requested the entrepreneur to visit them to carry out urgent repairs or maintenance; if the entrepreneur provides additional services or delivers items other than replacement parts necessary for the repairs or maintenance, the right of withdrawal applies to the additional services or items;
   • i) where the subject of the performance are sound or visual recordings or computer software delivered in sealed packaging if the packaging was opened after delivery;
   • j) for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts;
   • k) concluded via a public auction;
   • l) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, or services related to leisure activities, if the contract specifies a specific date or period of performance;
   • m) for the supply of digital content not supplied on a tangible medium, if the performance began with the consumer's prior express consent and acknowledgment that they would lose their right of withdrawal.
