1. DEFINITIONS
Terms used in these Terms and Conditions shall mean:
- Customer – a natural person, a legal person, or an organizational unit without legal personality, whose specific provisions grant legal capacity, placing an order as part of the online store's operation.
- Terms and Conditions – these Terms and Conditions.
- Online Store (Store) – an online service available under the domain www.sklep-carmen.pl, through which the Customer can place orders and enter into sales contracts with us.
- Seller, Service Provider, Entrepreneur – Karol Stawczyk conducting business under the name Sklep Taneczny Carmen Karol Stawczyk, with its registered office at ul. Godebskiego 27a, 05-090 Raszyn, holding tax identification number NIP 796-174-08-07, registered in the Central Register and Information on Economic Activity (CEIDG) of the Republic of Poland maintained by the minister responsible for the economy.
2. GENERAL PROVISIONS
- These Terms and Conditions define the rules for using the online store available at http://obuwie-taneczne.pl.
- These Terms and Conditions are the regulations referred to in Article 8 of the Act on Providing Services by Electronic Means.
- The Terms and Conditions are available continuously on the Online Store's website, enabling Customers to reproduce and store its content. Customers can access these Terms and Conditions at any time through the link in the store's footer in the Information section on every page of the service at http://obuwie-taneczne.pl/info/regulamin. The Seller sends the content of the Terms and Conditions by email in a .pdf file as an attachment to the order, no later than the moment when the service begins to be provided.
- These Terms and Conditions specify in particular:
- a) the rules for registering and using an account within the online store,
- b) the conditions and rules for making electronic reservations of products available within the online store,
- c) the conditions and rules for placing orders electronically within the online store,
- d) the rules for concluding sales contracts using the services provided within the Online Store.
- Using the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
- a) The Customer can use the Store through devices connected to the Internet (computer, phone) with an internet browser, e.g., Firefox, Internet Explorer, Edge, Opera, Chrome, or a phone with Java applet support enabled.
- To use the online store, the Customer must independently gain access to a computer or terminal device with Internet access. Information about the goods provided on the Online Store’s website, including their descriptions, technical parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
3. RULES OF USING THE ONLINE STORE
- Contracts may be concluded by Customers who have or do not have an account within the Online Store.
- The registration of a product order is carried out by completing and accepting the transaction registration form provided on one of the Store's pages.
- To ensure the safety of communication and data transfer concerning the services provided within the Website, the Online Store applies technical and organizational measures appropriate to the level of risk to the safety of provided services, particularly measures to prevent unauthorized persons from obtaining and modifying personal data transmitted online (implemented secure SSL-encrypted connection system).
- The Customer is obligated to:
- a) refrain from providing or transmitting content prohibited by law, e.g., content promoting violence, defamation, or violating personal rights and other rights of third parties;
- b) use the Online Store in a way that does not interfere with its functioning, particularly by using specific software or devices;
- c) refrain from taking actions such as sending or placing unsolicited commercial information (spam) within the Online Store;
- d) use the Online Store in a non-disruptive way for other customers and the Service Provider;
- e) use any content posted within the Online Store solely for personal use;
- f) use the Online Store in a manner consistent with the applicable laws of the Republic of Poland, the provisions of these Terms and Conditions, and general rules for using the Internet.
4. PROCEDURE FOR CONCLUDING A SALES CONTRACT
- To conclude a sales contract via the Online Store, one should visit http://obuwie-taneczne.pl, select, for example, footwear and its color, size, or footwear accessories offered by the Store, and take subsequent technical steps based on the messages displayed to the Customer and information available on the website.
- The Customer selects the ordered Goods by adding them to the cart.
- During the order submission process, the Customer can modify the entered data and the selection of Goods. To do this, follow the messages displayed to the Customer and the information available on the website.
- After providing all the necessary data, a summary of the placed order will be displayed. The summary will include information about:
- a) the subject of the order,
- b) the unit and total price of the ordered products, including delivery costs and any additional costs (if applicable),
- c) the selected payment method,
- d) the selected delivery method,
- e) the estimated delivery time.
- To send/submit the Order, it is necessary to check the box labeled "I order with an obligation to pay," provide mandatory personal data, and click the button labeled "I order with an obligation to pay."
- Sending the Order by the Customer constitutes a declaration of will to conclude a sales contract with Sklep Taneczny Carmen Karol Stawczyk, as per these Terms and Conditions (purchase offer).
- After submitting the Order, the Customer receives an email titled "[Sklep Carmen] - Order Confirmation," containing the final confirmation of all essential elements of the Order (order acceptance). The Seller attaches the Terms and Conditions along with other attachments, such as the return form, privacy policy, and withdrawal terms, to this message.
- The contract is considered concluded upon the Customer receiving the email mentioned above.
- The sales contract is concluded in Polish, with content consistent with these Terms and Conditions.
